Mediation Services for Dispute Resolution

What is Mediation?

Mediation is a structured negotiation process where an independent individual, referred to as a mediator, helps the parties involved identify and assess options while negotiating an agreement to resolve their dispute. This mediation serves as an alternative to having a judge impose a decision on the parties involved.

What cases are suitable for mediation?

In the realm of dispute resolution, all cases, regardless of their complexity or the number of parties, can be referred to mediation. Common issues suitable for mediation include those related to commercial and corporations law, intellectual property, industrial law, consumer law, human rights, admiralty, and family matters.

Some examples include:

- A willingness to participate in mediation

- The possibility that a judge's decision might not resolve the dispute

- The need for parties to find a way to preserve their relationship

- The existence of non-monetary factors

- The potential for a negotiated outcome that may better meet the needs and interests of the parties than a decision handed down by a judge.
